Acre: British Imperial
Measurement of area. It is equal to 4 roods, OR in the Metric
System equal approximately to 4050 Square Metres or .4
hectares.
Affidavit: A written statement
in the name of the person/s - the deponent/s - voluntarily
signed & sworn whereas a Statutory Declaration refers to
the Oaths Act.
Amalgamate, Request
to: When one Deed is required for adjoining
properties.
Annuity: Yearly sum
payable
Area: See area conversion
table.
Attorney: One appointed by
another to do something in his stead.
Attorney at law: One who is
put in place of another to manage his matters of Law.
Balanced Title(Request): When
separated deed required for remaining portion of original title
& no Transfer required.
Caveat: A warning by
entry in a register. Process of suspending proceedings. To
restrain some other person from purchasing land.
Caveator: A person entering a
caveat.
Certificate of Title: A
Certificate drawn up by the Titles Office showing detail of
land.
Cestui que trust: The person
for whose benefit a trust is created.
Chattel: Any property other
than freehold land.
Consanquinity: Relationship by
blood descent.
Contract: Agreement
enforceable by law.
Contract of Sale: Agreement
outlining the terms of sale.
Conversion Table: Tables by
which various areas and dimensions are compared.
Conveyancing: The transfer of
ownership of property.
Covenant: Agreement creating
an obligation contained in a Deed.
Corporation: A body of persons
having Law an existence, right and duties distinct from those
of the persons who form it.
Creation of a Charge: A form
of security for the payment of a debt on performance on an
obligation.
Crown Leasehold: Land leased
from the Crown (or King/Queen) for some years or a defined
period.
Declarant: One who declares in
the presence of a Justice of the Peace.
Declaration of Search:
Specific document declaring that searches have been made to
establish that no probate or letters of administration have
been lodged in the Supreme Court.
Deed of Grant: Prior to 1857
owners were required to hold Deed of Grant as proof of
Ownership
Deed Poll: A written
instrument for publishing a Change of Name.
Deed (Title Deed): The
documents and instruments conferring or evidencing the Title of
Land
Dividing Fences: Fences
between adjoining properties
Devisee: A recipient of
property by Will.
