Explanations for words and terms,
E to

Easement: A right enjoyed by
the Owner of lands over the lands of another - such as:- Right
of Way; Right of Support: Right of flow of air or water are
created by express grant or prescription and is a privilege
without profit.
Easement (Negative): Restricts
the use the owner of the servient tenement may make of his
land.
Easement (Positive): Consists
of a right to do something on the land of another.
Encumbrance: Any charge on
land for the purpose of securing the payment of an annuity or
sum of money other than a loan.
Equitable Mortgage Caveat: One
which passes only an equitable estate or interest.
Execute: To sign.
Executor: One who carries the
provisions of a Will into effect.
Fee simple: Nearest approach
to full ownership of land which current property laws
recognises.
Fences (Boundary): Fences
which only enclose one property.
Fences (Dividing): Fences
which are constructed between adjourning properties.
Freehold: When property is
held in fee simple by a person for tem of life.
Freeways: Main Roads on which
no Toll is paid. They usually join cities and towns.
Gift: A gratuitious grant or
transfer pf property.
Grantee: The person to whom
the Grant id made.
Grantor: The person making the
Grant.
Group Title: Requires
something that is common to all parties e.g. Common wall in
Maisonettes, Drives, Fences, etc. From the centre of the earth
to the sky and from wall to wall but does not include Strata
Title.
Hectare: Unit of
measurement in metric system for larger land areas
Approx. 2.5 acres.
Indenture: A document written
in duplicate on the same parchment or paper and divided into
two by cutting through a wavy line.
Iter Alia: Among others.
Inter se: Between
themselves.
Intestatus: When a person dies
and has not left a Will.
Joint Tenants: Upon the death
of a Joint Tenant ownership vests in the remaining Joint
Tenant.
Jurat: A memorandum at the end
of an affidavit stating where and when Sworn.
Land Tax: Tax payable to the
Government via the State Land Tax Department.
Lease: A conveyance or grant
of the possession of property to last during the life of a
person or for a fixed period usually with the reservation of
rent
Legacy: A gift by
will.
Legatee: The beneficiary of a
legacy.
Lessee: A person to whom
a lease is made.
Lessor: A person by whom
a lease is made.
Lien: Right to hold another's
property (chattels) until debt is paid in full.
