Australia continued the English method of recording land
transfers, which required the owner of the land to have in his
possession the original Deed of Grant, as
well as all documents ever entered into by successive
owners.
This became known as Old System with the introduction of the
Torrens Title System in 1857 by
Sir Robert Torrens, the then Register
General in South Australia.
As a previous collector of customs he appreciated the simple
method used to register shipping and deplored the cumbersome
and expensive procedure of the day to register land
transfers.
Registration was to prove ownership and responsibility was
with the Government and the Registered Proprietor held the
duplicate. All changes of ownership and encumbrances were
recorded by a rubber stamp.
A similar Act was adopted in Queensland in 1861, a year
before the remaining states.
The Land Titles Act 1994 in Queensland
introduced the computer to record land transactions, dispensing
with paper records.
